Etsy Seller Legal Checklist
The privacy, policy, tax and IP items an Etsy shop needs — including what Etsy handles for you and what it does not.
Etsy is a marketplace, not a shield. It processes payments and collects certain taxes, but you are an independent seller and a data controller for the buyer information you receive. That split is what this checklist is about: knowing which items Etsy covers and which are yours.
1. A privacy policy that reflects a marketplace
Etsy's Seller Policy requires you to comply with data protection law for the buyer data you handle, and if you sell to the EU or UK the GDPR applies to you directly. The data you actually receive is narrow but real: name, shipping address, order contents, buyer messages, and any customisation details a buyer types in — which sometimes includes a child's name and birth date on a personalised item.
Name the tools you use beyond Etsy: a shipping label service such as Pirate Ship, a print-on-demand partner such as Printful that receives the buyer's address directly, and any email list you add buyers to. Adding buyers to a marketing list without asking is one of the most common breaches in handmade shops — an order is not consent to market.
2. Shop policies in the fields Etsy gives you
Fill in Etsy's structured policy sections rather than putting everything in the description: processing times, shipping, returns and exchanges, and cancellations. EU and UK buyers generally have a 14-day right to withdraw from distance sales, with a well-known carve-out for genuinely personalised or made-to-order goods — state which of your items that applies to, because a vague policy defaults against you in a case.
3. Tax, in two separate parts
Etsy collects and remits VAT, GST and US sales tax in many jurisdictions as a marketplace facilitator, so you generally do not add those yourself on Etsy orders. That does not touch your own income tax, your registration obligations if you also sell off-Etsy, or import duties your buyer may owe. If you sell digital downloads to the EU, check the current treatment before assuming Etsy has handled it.
4. Intellectual property, both directions
Etsy removes listings on IP complaints quickly and repeat reports risk your shop. Practical checks: fan-art and character-adjacent designs are the usual cause; 'inspired by' does not cure a trademark; product photos must be yours; and font and clipart licences frequently forbid commercial use or resale in a digital product. Keep your licence receipts in one folder so you can respond to a claim with evidence rather than memory.
5. Where to publish the policy
Etsy has no dedicated privacy policy field, so host the document on a page you control — a simple site, a Notion page or a Carrd — and link it in your shop's About section, in the policies area, and in your order confirmation message. If you also run a Shopify or Wix storefront, the same document can serve both, provided it names both channels.
